The Writ Petition sought for declaration that the property in the suit automatically released in terms of Section 38 of the Town and Country Planning Act, 1971. The writ petition was stood allowed on 08.04.2024.
2. It is the grievance of Mr.S.Karthikei Balan that consequential proceedings had not been issued by the respondents. Hence, this petition for contempt.
3. I am of the view that once the High Court has given a declaration, Page Nos.2/4
the Executive has no role to confirm the said order. Though the consequential proceedings have absolutely unessential, Mr.L.S.M.Hasan Fizal appearing for the respondents states that the respondents have passed orders on 15.4.2025 and 19.09.2025. The copies of orders dated 15.04.2025 and 19.09.2025 have been handed over to Mr.S.Karthikei Balan. Hence, this Contempt Petition stands closed.
