This petition has been filed to withdraw and transfer the HMOP.No. 10 of 2024 pending on the file of Family Court, Thanjavur to Sub Court, Alandur to be tried along with HMOP.No.466 of 2024.

The learned counsel appearing for the petitioner / wife would submit that the respondent / husband has filed a petition under Section 13 (i) (i-a) of Hindu Marriage Act seeking to declare the marriage between the petitioner and the respondent held on 01.02.2023 as null and void in HMOP.No.10 of 2024 on the file of the Family Court, Thanjavur, which is pending. He further submits that the petitioner / wife filed an application under Section 13 (1) (i-a) of the Hindu Marriage Act seeking for dissolving the marriage took place between the petitioner and the respondent solemnized on 01.02.2023 in HMOP.No.466 of 2024 on the file of the Sub Court, Alandur, which is pending. The petitioner is a Doctor and now she is in Chennai. She is not able to go to Thanjavur for every hearing, which is nearly 700 kms up and down. If she go for one day, her Doctor profession will be spoiled and the patients who come to her will change the Doctor when she was not available at the clinic.

3. There is no representation for the respondent.

4. In view of the above and also considering the submissions made by the learned counsel for the petitioner, there can be no impediment for allowing this petition as prayed for.

5. Accordingly, this transfer civil miscellaneous petition is allowed. The case in HMOP.No.10 of 2024 is hereby withdrawn from the file of the Family Court, Thanjavur and transferred to the file of the Sub Court, Alandur to be tried along with HMOP.No.466 of 2024 on the file of the Sub Court, Alandur. Considering the facts there shall be no orders as to costs.
