ORDER
This writ petition has been filed to direct the the first respondent herein to consider the petitioner's application dated 06.05.2024.
2. Mr.D.Ravichander, learned Special Government Pleader takes notice on behalf of the respondents. By consent of both the parties, this writ petition is taken up for final hearing at the admission stage itself.
3. The case of the petitioner is that the property situated at Survey No.135/2B Kuthalam, Mayiladuthurai District originally belonged to petitioner's father. After his demise, the title over the said property was automatically transferred in the name of the petitioner, his mother and his bothers & sisters. Further, they have also got joint patta for the aforesaid property. Thereafter, the petitioner has applied for transfer of patta on his favour, before the third respondent, which was rejected on 15.02.2025 on the ground that the petitioner was not in possession of the property. Pursuant thereto, the petitioner approached the first respondent 2/6
and made an application dated 06.05.2024, seeking transfer of patta. However, the said application was not considered, as on date. Hence, the petitioner has come forward with the present writ petition.
4. Though many grounds have been raised in this writ petition, learned counsel for the petitioner submitted that it would suffice, if this Court issues direction to the first respondent to consider the petitioner's application dated 06.05.2024.
5. Learned Special Government Pleader appearing for the respondents submitted that the petitioner has not sent any application to the first respondent. In the event, any application is submitted by the petitioner, the same would be considered and orders passed within a time frame that may be fixed by this Court.
6. Heard the learned counsel on either side and perused the materials available on record.
7. In view of the above facts and circumstances of the case, this 3/6
writ petition stands dismissed. However, liberty is granted to the petitioner to file a fresh application for patta transfer before the concerned authority, within a period of two weeks from the date of receipt of a copy of this order. Upon such receipt, the authority concerned is directed to consider the same on merits and in accordance with law and pass appropriate orders, within a period of eight weeks thereof.
With the aforesaid directions, this writ petition is disposed of. No costs.
