The petitioner, G.Subramanian @ Govi Subramaniam, has filed this petition, seeking a direction to the respondent to consider his representation dated 18.02.2016.
2.The grievance of the petitioner is that he has been appointed as Conductor on 11.07.1979 in the respondent Corporation. While so, after rendering about 10 years of service, a charge memo has been issued against the petitioner alleging that he had indulged in money lending activities and printed calender in the name of Transport Corporation, without getting prior permission from them. The petitioner submitted his explanation on 24.06.1988, denying the charges. Not satisfied with the explanation offered by the petitioner, the respondent dismissed him from service, by order dated 12.12.1989. Aggrieved over the same, the petitioner filed I.D. No.30 of 1999 before the Labour Court, Cuddalore, questioning the correctness of the order of the Management, dismissing him from service. By order dated 24.02.2004, the Labour Court, directed the respondent to re-instate the petitioner into service with 50% back wages, continuity of service and other benefits. Corporation has filed W.P. No.34274 of 2004 before this Court. By order dated 08.11.2013, this Court dismissed the said writ petition. Thereafter, the petitioner made a representation dated 18.02.2016 requesting the respondent to comply with the said order. As there was no response from the respondent, the petitioner is before this Court.
3.Heard the learned counsel appearing for the petitioner and the learned Standing Counsel appearing for the respondent. 4.In the light of the limited relief sought for in the writ petition, without going into the merits of the case, the respondent is directed to consider the petitioner's representation dated 18.02.2016 and pass orders, on merits and in accordance with law, within a period of eight weeks from the date of receipt of a copy of this order.
