Will (7) Of G.V.Jayalakshmi v. G.S.Venkatramani

OP No.917 of 2017 R.SUBRAMANIAN.J., This Original Petition has been filed for issuance of probate for the last will and testament dated 05.08.2011 executed by Late G.V.Jayalakshmi, who died on 09.11.2014. The petitioners have been appointed as exectutors of the said Will. The respondents are the children of the brother and sister of the deceased G.V.Jayalakshmi, who died as a spinster.

2. The 2nd petitioner has been examined as P.W.1. She has produced the death certificate of the deceased G.V.Jayalakshmi, as Ex.P1. The Original last Will and Testament dated 05.08.2011 has been produced as Ex.P2. The consent affidavits of all the respondents have been produced as Exs. P3 to P18.

3. The petitioners have also examined one R.Mariyappan, who is an attesting witness to the said Will. He has spoken about the execution of the Will by the testator and its attestation by himself and Mr.M.Rajesh.

4. In view of the said evidence, the execution of the Will stands proved. Hence, the Original Petition is allowed granting probate for the last will and testament dated 05.08.2011.
