ORDER

The petitioner, who was arrested and remanded to judicial custody on 25.07.2025, for the offences punishable under Sections 194 (3) of BNSS Act @ 296(b), 85, 108, 49 of BNS and 4B(2) of TNPWH Act and Section 6(A), 6(B), 23(1), 23(3), 25 of TNDT Act, 1994 in Crime No. 179 of 2025, on the file of the respondent police, seeks bail.

2. The case of the prosecution as per the defacto complainant, who is the father of the deceased, is that the petitioner along with other accused persons harassed the deceased due to which, the deceased got frustrated and committed suicide along with her female child by jumping into a well. Hence, the case.

3. Learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and she has been falsely implicated in this case. He also submitted that the petitioner is in no way connected with the alleged offence, however, she is suffering incarceration from 25.07.2025. He further submitted that the petitioner is ready to abide by any stringent condition that may be imposed by this Court. Hence, he prayed for grant of bail to the petitioner.

Learned Government Advocate (Crl.side) appearing for the respondent police, submitted that totally there are seven accused in this case and the petitioner, arrayed as A7, was arrested on 25.07.2025. He submits that the deceased was the wife of A1 and they had a female child aged about 1 1⁄2 years. At the time of occurrence, the deceased was 5 months pregnant. Since the 1st accused and other in-laws were pressurising the deceased to abort the fetus, she committed suicide by jumping into a well along with her 1 1⁄2 years old female child. Hence, he strongly opposed to grant bail to the petitioner.

5. Heard both sides and perused the materials available on record.

6. Considering the facts and circumstances of the case, nature of allegations, submissions made by the learned counsels on either side, considering the gravity of the offence committed by the petitioner, this Court is not inclined to grant bail to the petitioner.
