This application has been filed to set aside the ex parte order dated 31.08.2023 passed in above O.P.No.453 of 2023 granting custody of the minor child.

2. It is the contention of the petitioner that since he was at UAE, he could not appear in time and was set ex parte and hence, seeks for setting aside the ex parte order.

3. The learned counsel for the respondent submits that respondent has no objection for allowing this application.

4. Considering the averments made in the application and the fact that other side has no objection for allowing this application, this application is allowed, ex parte order dated 31.08.2023 is set aside and the OP is restored to file.
