This Court by its order dated 09.11.2023 had allowed A. No.5677 of 2023 seeking to condone the delay of 18 days in filing the restoration application. The restoration application has been filed to restore the suit which was dismissed for default on 16.08.2023. Even though, the learned counsel for the defendant has raised objection with regard to allowing of this application, which has been filed to restore the suit, which was dismissed for default, this Court after giving due consideration to the contents of the affidavit filed in support of this application is of the considered view that sufficient cause has been shown by the applicant for allowing this application. Accordingly, this application is allowed as prayed for and the suit is restored to file. The learned counsel for the plaintiff would submit that an application has been filed to bring on record the LR's of the deceased second defendant. Registry is directed to number the said application, if it is otherwise in order and list the same for hearing on the next hearing date. Post the matter on 08.12.2023.
