This application has been filed to reopen the evidence of the defendant side.

2. The learned counsel appearing for the plaintiff and the learned counsel appearing for the defendants 1 and 3 submitted that as the evidence has already been closed, the evidence against the defendant side cannot be reopened.

3. It is the contention of the learned counsel for applicant/4th defendant that the learned counsel appearing for the defendants 1 and 3 has also appeared for the applicant, however, the evidence was closed without examination of the applicant.

4. Having regard to the nature of allegations found in the affidavit and in order to give sufficient opportunity to the 4th defendant, this Court is inclined to reopen the evidence. Accordingly, this application is allowed. Page No.1/3

5. Post the matter before the learned Master on 11.11.2019, for recording evidence on the side of the defendants and the same shall be completed on or before 29.11.2019. Thereafter, list the matter before this Court on 09.12.2019.
