O R D E R

The petitioner, who was arrested and remanded to judicial custody on 16.07.2025, for the offence punishable under Sections 87 of BNS Act 2023 and Sections 9 and 10 of Prohibition of Child Marriage Act 2006 in Cr.No.29 of 2025, on the file of the respondent, seeks bail.

2. The petitioner herein was arrested on 16.07.2025, on the complaint 1/4

given by the Village Welfare Officer, Thondamuthur Municipality. The case of 14 years old child had been subjected to penetrative sexual assault by this petitioner under the guise of a valid marriage. The persons who have assisted the petitioner to kidnap the girl and solemnized the marriage of the other accused.

3. The learned counsel appearing for the petitioner submitted that initially the case was registered only for the offence under Sections 9 and 10 of Prohibition of Child Marriage Act 2006 and later altered into graver offence under Section 5 r/w of 6 of POCSO Act. The said alteration was due to the statement given by the victim girl to the learned Judicial Magistrate, where the case of penetrative sexual assault been made out and the victim girl being below 15 years old, the Section has been necessarily altered.

4. Considering the fact that the investigation is still at very crucial stage, this Court is not inclined to grant bail to the petitioner. Hence, this Criminal Original Petition for bail stands dismissed. 26.08.2025 Vv To 1.The Judicial Magistrate, 2/4
