ORDER
This writ petition is filed by the petitioner to call for the records relating the impugned Refusal Check Slip in No.RFL/47/2025 dated 01.08.2025 of the third respondent and quash the same as illegal and consequently direct the third respondent to register the Trust deed dated 01.08.2025 presented by the petitioner in respect of the trust created under the name of 'THENMAVANTHAL GRAMA MUNNETRA ARRAKATTALAI'.
2. Mr.P.Harish,, learned Government Advocate, takes notice on behalf of the respondents. By consent of both parties, this writ petition is taken up for final disposal at the admission stage itself. 2/6
3. Learned counsel for the petitioner submitted the petitioner found a trust named "Thenmavanthal Ettiyamman Grama Munnetra Arakkatalai" and the trust deed dated 24.07.2025 was executed, laying out the object of the trust, which is to function as a non-profit organisation. However, the third respondent refused to register the same, citing the reason that the Trust's name was derived from the "Ettiyamman Temple", a public temple in Thenmavanthal village, allegedly opposed by some residents that the Trust would interfere with the temple's function. Therefore, the petitioner executed a fresh Trust deed under different name called "Thenmavanthal Grama Munnetra Arakkatalai" dated 01.08.2025, however, the third respondent once again rejected the same vide order dated 01.08.2025, citing the previous reason and directed the petitioner to obtain NOC from the HR&CE department. Challenging the said refusal check slip dated 01.08.2025, the petitioner has come forward with the present writ petition.
4. Learned Government Advocate appearing for the respondents would submit that since the name of the petitioner's Trust has been 3/6
changed from "Thenmavanthal Ettiyamman Grama Munnetra Arakkatalai" tto "Thenmavanthal Grama Munnetra Arakkatalai", the third respondent has no problem to register the same.
5. Heard the learned counsel on either side and perused the materials available on record.
6. In view of the submission made by the learned Government Advocate appearing for the respondents, this Court is inclined to set aside the impugned order dated 01.08.2025 passed by the third respondent. Accordingly, the same is set aside. Consequently, this Court directs the third respondent to register the petitioner's Trust deed, within a period of one week from the date of receipt of a copy of this order. In the result, this writ petition stands allowed. No costs. 17.09.2025 4/6
