(Order of the Court was made by the Hon'ble Chief Justice) Counsel for applicant seeks stay of the impugned judgment dated 30.04.2021 passed in COS.No.1 of 2020 by Principal District Judge (Commercial) Court, Salem.

2. Counsel offers, on instructions, to deposit 50% of the amount. Counsel also admits that even in the plaint, plaintiff has admitted that he has borrowed money and the outstanding was Rs.7,50,000/-. The amount, as decreed, payable to plaintiff, that is respondent in the appeal, as on date, works out to approximately Rs.10.73 lakhs.

3. There shall be an order of interim stay on condition that appellant shall deposit 75% of this amount, which is rounded off to Rs.7,75,000/- (Rupees seven lakhs seventy five thousand only) within two weeks from today before the Court below. If the amount is not deposited within two weeks from today, there shall be no stay of the impugned judgment.

This C.M.P. is disposed of.
