These petitions have been filed seeking to condone the delay of 316 days in filing the appeals against the decree and judgment passed in OS Nos.337 & 433 of 2016, respectively, on the file of the III Additional District Judge, Coimbatore. 2.Notice had been directed to the respondent, notice had been served and counsel had entered appearance. It had also come to light that the respondent had filed execution petitions in E.P.Nos.12 of 2024 & 73 of 2025, which are also pending before the III Additional District Judge, Coimbatore. But however, counter had not been filed on behalf of the respondent. The learned counsel sought time, but perusal of the records shows that more than sufficient opportunity was granted to the respondent. 3.In the affidavit filed in support of the petitions explaining reasons for the delay, it had been stated that the husband of the petitioner, Senthil Kumar Nanjappan was admitted in hospital from July 2023 and died on 10.11.2023 and his final rituals 1/3
ended on January 2024. In that particular period, it was not possible for the petitioner to file the appeals as funds could not be mobilized to pay the Court fees and also the Advocate fees. The reason appears to be reasonable. We would therefore condone the delay and the petitions stand allowed.
4.Registry to number the appeals, if they are otherwise in order and print the name of M/s.M.Marudhachalam and M.Vishali for the respondent in the cause list when the appeals are listed for admission.
