The petitioner, who apprehends arrest at the hands of the respondent Police for the offences under Sections 294(b), 324 and 506(2) IPC altered under Sections 294(b) and 307 IPC in Crime No.224 of 2023 seeks anticipatory bail.

2. The learned counsel for the petitioner stated that the petitioner is an innocent person and he has been falsely implicated for the offences under Sections 294(b), 324 and 506(2) IPC altered under Sections 294(b) and 307 IPC in Crime No.224 of 2023. Thus, he seeks anticipatory bail to the petitioner.

3. It is stated by the learned Government Advocate (Crl.Side) submitted that the defacto complainant is the brother of the petitioner herein. There was a land dispute between them and owing to that petitioner had attacked the defacto complainant and caused multiple fractures. It is stated that the injured are grievous in nature. A Counter complaint had been lodged 1/3

and subsequently a First Information Report was also registered. However, he prayed for dismissal of this petition.

4. Taking into consideration the nature of the offences, and the fact that though one of the co-accused had been granted anticipatory bail, in view of the overt act against this petitioner, I am not inclined to grant anticipatory bail to the petitioner. Accordingly, this Criminal Original Petition is dismissed.
