ORDER

This Criminal Original Petition has been filed to set aside the condition imposed by the appellate Court to deposit 10% of the compensation amount within a period of sixty days in Crl.M.P.No.6693/2024 in Crl.A.No.221/2024 by an order dated 07.11.2024 and consequently grant further time to comply with the said condition.

2. The petitioner, who suffered conviction in S.T.C.No.630 of 2021 for the offence under section 138 of the Negotiable Instruments Act had preferred an appeal before the Principal Sessions Judge at Thiruvallur. The Principal Sessions Judge, while suspending the sentence of the petitioner had directed the petitioner to deposit 10% of the compensation amount within 60 days before the trial Court. As the petitioner had not deposited the said amount within the time, the present petition has been filed seeking extension of time. It is the contention of the petitioner that as he was suffering from heart ailments and he was taking treatment in his native place, he was not able to deposit the compensation amount.

3. Considering the fact that the petitioner was directed to deposit the amount on 07.11.2024 and till date the amount has not been deposited and taking note of the delay, the petitioner is directed to deposit 10% of the compensation amount within a period of three weeks from the date of receipt of a copy of this Order.

4. With the above direction, this Criminal Original Petition is disposed of.
