State rep. by 1.The Superintendent of Police, Thiruvannamalai District.
2.The Inspector of Police, Kannamangalam Police Station, Thiruvannamalai District.
(Crime No.197 of 2002) ... Respondents PRAYER: Criminal Original Petition filed under Section 482 of the Code of Criminal Procedure, to direct the respondents to reopen the file relating to Crime No.197 of 2002 on the file of 2nd respondent i.e., Inspector of Police, Kannamangalam Police Station, Thiruvannamalai District and reinvestigate the case.
For Petitioner : Mr.C.Saravanakumar For Respondents : Mr.A.Gopinath Government Advocate (Crl. Side)
ORDER
This Criminal Original Petition has been filed for a direction to the respondent police to reinvestigate the case in Crime No.197 of 2002. 1/4
2. This Court directed the second respondent to file a status report and accordingly status report has been filed before this Court. On going through the status report, it is seen that the case was registered in Crime No.197 of 2002 under Section 174 of Cr.P.C. Thereafter RDO enquiry was conducted and it was ascertained that the deceased did not die due to any dowry harassment. Accordingly the case was dropped as early as on 19.02.2003.
3. The present petition has been filed by the sister of the deceased after nearly 20 years seeking for reinvestigation. In the considered view of this Court, there is absolutely no explanation given as to why it took 20 years for filing this petition and it will be too difficult for the police to do any investigation at this length of time.
Accordingly, this Criminal Original Petition is dismissed. 18.07.2023 Index : Yes/No Internet : Yes/No Speaking Order/Non-Speaking Order rsi 2/4
