This Criminal Original Petition is filed by the 12th accused in C.C.No.46/2015 pending on the file of Judicial Magistrate-1, Cuddalore. 1/4
2. The Learned Counsel appearing for the petitioner states that the present petition is filed for speedy disposal of the case since the trial is pending for more than 9 years.
3. The Learned Government Advocate (Crl.Side) for the respondent states that out of 15 accused, 2 of the accused (A3 & A4) are absconding and Non-Bailable Warrant was pending for long time. Since the prosecution has filed an application to split up the case against the two absconding accused and to proceed with the other accused. The said application is posted for consideration on 07.11.2024.
4. Considering the fact that the matter is already 9 years old, it is necessary to direct the trial Court to expedite the trial and if any accused is absconding, case may be split up against them in accordance with law and proceed with other accused and complete the trial as early as possible.
5. With this direction, this Criminal Original Petition is disposed of.
