The petitioner/A2 who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 7 and 20(1) of Cigarette and Other Tabacco Products Act, 2003 and under Sections 273 and 328 of IPC in Crime No.359 of 2023, seeks anticipatory bail. 2.It is stated that A1 had been taken into custody and had been released on bail, but however it is the case of the prosecution on 03.06.2023, the respondent had arrived at restaurant, Rajasthan Dhaba and had arrested A1. He was in possession of 840 Kgs of banned Tobacco products. It is also stated that 450 Kgs of banned Tobacco products were seized from the Mahindra Bolero car bearing Registration No.RJ-No-24-UA-2269 and 390 Kgs of banned Tobacco products had been seized from Toyota Innova car bearing Registration No.GJ-No-12CG-6816. 1/2 https://www.mhc.tn.gov.in/judis

smv 3.Taking all these factors into consideration, it is not a case where anticipatory bail can be granted to the petitioner. There is every possibility of the petitioner absconding. This petition is therefore dismissed.
