ORDER

The petitioner, who was arrested and remanded to judicial custody on 01.07.2025, for the offences punishable under Sections 8(c) r/w 20(b)(ii)(B) of NDPS Act, 1985 in Crime No. 106 of 2025, on the file of the respondent police, seeks bail.

2.The case of the prosecution is that based on the secret information, the respondent went to the scene of occurrence and found that the petitioner was found to be in illegal possession of 1 kg 300 grams of banned tobacco products. Hence, the case.

3. The learned counsel for the petitioner submits that the petitioner is an innocent person and he has been falsely implicated in this case. He submits that he has not committed any offence as alleged by the prosecution. He also submits that the petitioner is ready to abide by any conditions that may be imposed by this Court. Hence, he prays for grant of bail to the petitioner.

4. The learned Government Advocate (Crl.side) for the respondent police, while opposing for grant of bail, submits that there are 22 previous cases pending against the petitioner. Hence, he opposed to grant bail to the petitioner.

5. The petitioner was found in illegal possession of 1 kg 300 grams of ganja and he was arrested on 01.07.2025. The learned counsel for the petitioner states that the petitioner is in prison and this is a foisted case. The learned Government Advocate (Crl.side) for the respondent police submits that in this case, investigation is pending and the offence has been committed by the petitioner while he was in bail in other case.

6. Considering the bad antecedent of the petitioner, this Court is not inclined to grant bail to the petitioner. Accordingly, the Criminal Original Petition stands dismissed for the present.
