This Criminal Original Petition has been filed seeking bail for the petitioners, who have been arrayed as accused in a case registered for the offence punishable under Section 304(2) of BNS, 2023 @ Section 310(2) of BNS, 2023. 1/2 https://www.mhc.tn.gov.in/judis

The learned Government Advocate (Crl.Side) appearing for the respondent police submitted that it is a case of phone snatching. The stolen phone has been recovered. He further submitted that the two wheeler used in the commission of the offence belongs to the 1st petitioner and the snatched cell phone was recovered from the 2nd petitioner. It was also submitted that the petitioners are habitual offenders, the 1st petitioner being involved 5 cases and the 2nd petitioner in 3 cases. The petitioners were arrested on 28.07.2025 and the investigation is pending.

Considering the nature of the crime and the propensity of the petitioners to commit such offence, this Court is not inclined to grant bail to them.
