ORDER

The Writ Petition is filed for the relief of a Mandamus, directing the 2nd respondent the Revenue Divisional Officer, Tamabram to dispose of the petitioner's application under the Maintenance and Welfare of Parents and Senior Citizens Act 2007 bearing Application No. Na.Ka. 1852/ 2024/ A dated 18.07.2024 seeking cancellation of the settlement deed registered as Document No. 6719 of 2015 dated 25.05.2015 on the file of the Sub Registrar, Guduvanchery, Chennai within a time frame to be fixed by this court considering the petitioner's advanced age and health condition.

2. The petitioner would submit that earlier he had executed a 2/6

settlement deed dated 25.05.2015 before the Sub Registrar Office, Guduvanchery, in favour of his daughter, Sangeetha. Thereafter, the petitioner made an application before the District Collector, Chengalpattu, seeking cancellation of the said deed. The District Collector, Chengalpattu forwarded the application to the Revenue Divisional Officer, Tambaram, for taking necessary action.

3. The petitioner would submit that no action has been taken by the 2nd respondent and the application has been kept pending. The petitioner would submit that he is 73 years old and is suffering from various ailments. Therefore, seeking a direction to the 2nd respondent to dispose of his application, the petitioner is before this Court.

4. Heard the learned counsels on the either side and perused the records.

5. The grievance of the petitioner is that he has made an 3/6

application dated 14.05.2024 to the 1st respondent seeking cancellation of the settlement deed. The 1st respondent has forwarded the same to the 2nd respondent to conduct an enquiry and dispose of the application. However, there is no action on the part of the 2nd respondent.

Considering the facts and circumstances of the case, a direction is issued to the 2nd respondent to dispose of the petitioner's application under the Maintenance and Welfare of Parents and Senior Citizens Act 2007 bearing Application No. Na.Ka. 1852/ 2024/ A dated 18.07.2024, after issuing due notice to the interested parties, within a period of 8 weeks, from the date of receipt of a copy of this order.

7. With the above direction, the Writ Petition is disposed of. No costs.
