O R D E R
The plaintiff in O.S.SR.No.3917 of 2025 on the file of the District Munif Court, Poonamallee. Originally, the Porur Welcome Nagar Kudieruppore Nala Sangam, represented by its President, C.Madurai, filed a suit against Arulmigu Ramanatheeswarar Koil, represented by its Executive Officer, seeking relief of permanent injunction and consequential reliefs.
2. The learned counsel appearing for the revision petitioner would submit that the plaint was originally filed before the Sub Court, Poonamallee. The learned Sub Court, Poonamallee, returned the plaint on 30.06.2025. Thereafter, the revision petitioner re-presented the same. Again, the learned Sub Court, Poonamallee, returned the plaint stating that the suit was not filed before the proper Court having pecuniary jurisdiction. Accordingly, the revision petitioner filed the plaint before the District Munisf Court, Poonamallee. However, the District Munisf Court, Poonthamalli, returned the plaint on 17.07.2025, stating that the suit ought to be filed before the proper Court having pecuniary jurisdiction. Subsequently, the revision petitioner represented the plaint, stating that the suit falls within the pecuniary jurisdiction of the District Munsif Court and also stated that no order had been 2/5
passed by the H.R & C.E Department, hence the suit is maintainable before the District Munisf Court. Nevertheless, the District Munisif Court once again returned the plaint on 28.07.2025, observing that the previous defects had not been complied with and that the Court has no jurisdiction to try the case against the H.R & C.E. Department. The plaint was therefore returned, stating that it should be filed before the proper forum. Aggrieved over the same, the revision petitioner has preferred the present Civil Revision Petition.
3. It is seen from the records that the Court below returned the plaint after raising certain quarries. It is for the revision petitioner to comply with the quaries raised by the Registry and to make necessary submissions, if any, before the open Court.
4. In view of the above, the revision petitioner is directed to re-present the plaint before the Court below with the required compliance. If there are still any queries regarding the maintainability of the plaint and other queries if any the same shall be considered by the Court below, in accordance with law, within a period of two weeks from the date of receipt of a copy of this order. 3/5
5. With the above observations, this Civil Revision Petition stands disposed of. No costs.
