CMP No.23003 of 2023 in CMA.SR.No.128372 of 2023 N.ANAND VENKATESH.,J The second respondent/Insurance Company has been served and is represented through counsel.

2.The present appeal has been filed only seeking for enhancement of compensation. Hence, notice to the first respondent is dispensed with since the second respondent sufficiently takes care of the interest of the first respondent on whose behalf the compensation to be paid to the second respondent.

3.This Civil Miscellaneous petition has been filed seeking to condone the delay of 41 days in filing the Civil Miscellaneous Appeal.

4.Heard the learned counsel for the Appellants and perused the records.

5.Having satisfied with the reasons assigned in the affidavit filed in support of this petition, the miscellaneous petition is allowed and the delay of 41 days is condoned.

6.The name of the counsel appearing for the Insurance Company shall be printed in the cause list at the time of admission.

7.The learned counsel appearing for the appellants is directed to serve the papers immediately on the learned counsel appearing on behalf of the Insurance Company.
