ORDER

The petitioner is the complainant and the respondent is the accused. The petitioner filed a private complaint under Section 138 of Negotiable Instruments Act, before the XXV Metropolitan Magistrate, Egmore, Chennai, in C.C.No.1134 of 2021 and the learned Magistrate after enquiry, dismissed the complaint. Challenging the said order, the complainant has filed the above appeal before this Court. Since, the appeal is against acquittal, he has also filed this Criminal Original petition to grant leave to prosecute the appeal.

2. Heard the learned counsel for the petitioner/appellant.

3. Though notice served to the respondent/accused and his name also being printed in the cause list, there is no representation for the respondent.

4. A perusal of the grounds of appeal shows that there are arguable points. Therefore, leave is granted.
