ORDER
This writ petition has been filed by the petitioner seeking to direct the 2 nd respondent to consider the representation dated 09.08.2024 and conduct appropriate proceedings as directed by the 1 st respondent in Na.Ka.No.Aa1/40505-10/2009 dated 27.08.2024.
2.Learned counsel for the petitioner would submit that the petitioner's land comprised in Survey New No.35/4B (Old No.35/4), New No.35/5B (Old No.35/5) & New No.35/6B (Old No.35/6), was acquired by the Government of Tamil Nadu for formation of new road gauge railway line between Tindivanam and Nagari. Further, the award of compensation was also passed by the 1 st
respondent in Na.Ka.No.Aa1/40405-10/2009 dated 22.06.2023. Since the petitioner's land was undervalued, the petitioner made an application dated 09.08.2024 under Section 64 of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation Act, 2013 to the 1 st respondent for enhanced compensation. Considering the same, the 1 st respondent passed an order in Na.Ka.No.Aa1/40505-10/2009 dated 27.08.2024, specifically directing the 2 nd respondent to conduct appropriate proceedings before the concerned Court. However, the 2 nd respondent failed to refer the matter to the Civil Court. Hence, the present writ petition has been filed. 3.Learned Additional Government Pleader appearing for the respondents would submit that within a period of two weeks time, the 2 nd respondent will refer the matter to the Civil Court.
4.Heard the learned counsel for the petitioner as well as the learned Additional Government Pleader appearing for the respondents.
5.Considering the submissions made by either parties and in view of the limited prayer sought for in this Writ Petition, without going into the merits of the case, this Court directs the 2 nd respondent to refer the matter to the Civil Court for the purpose determining the higher compensation within a period of two weeks from the date of receipt of a copy of this order. 6.With the above directions, this writ petition is disposed of.
