This petition is filed seeking to restore the Civil Miscellaneous Second Appeal which was dismissed for nonprosecution on 23.08.2023.

2. Heard the learned counsel for the petitioner/appellant.

3. Mr.N.Suresh, learned counsel for the first respondent has no objection for the order, dated 23.08.2023 being set aside and the civil miscellaneous second appeal being restored to file.

4. Being satisfied with the reasons stated in the affidavit filed in support of the petition, this petition is ordered and C.M.S.A.No.12 of 2019 is restored to file.

5. Post the main C.M.S.A.No.12 of 2019 on 21.11.2023.
