Prayer:- Writ petition filed under Article 226 of the Constitution of India praying for issuance of a writ of Mandamus, Directing the respondent to disburse the balance of the retirement benefits due to the petitioner, namely gratuity, earned leave, EPF Contributions, and other eligible dues, as per rules and eligibility, by considering the petitioner representation dated 28.04.2025 within a time frame fixed by this Hon'ble Court, along with interest at the rate of 12 percent per annum for the delayed payment. The Writ Petition is filed for the following reliefs:- " Directing the respondent to disburse the balance of the retirement benefits due to the petitioner, namely gratuity, earned leave, EPF Contributions, and other eligible dues, as per rules and eligibility, by considering the petitioner representation dated 28.04.2025 within a time frame fixed by this Hon'ble Court, along with interest at the rate of 12 percent per annum for the delayed payment."

2.Brief Facts:-

3. The petitioner was employed as a Salesman under the 5th respondent Society and had retired from services on 31.03.2025. According to the petitioner, under various heads, the total amount that is payable to him by the respondents is a sum of Rs.13,42,528/-. The petitioner had made a representation to the respondents 2 to 4 requesting the settlement of his dues before his retirement. Thereafter, only a partial amount has been paid by the officials. The respondents 2 and 3 have also admitted that after paying a partial amount, an amount of Rs.8,97,927.77/- is still payable to the petitioner.

4. On 28.04.2025, the petitioner had sent a detailed representation to the 3rd respondent seeking disbursement of his retirement benefits. However, the respondents have not taken any concrete steps to disburse the due amount. Hence, the Writ Petition.

5. Heard the learned counsel on either side.

6. Considering the fact that respondents 2 and 3 have themselves admitted that a sum of Rs.8,97,927.77/- is payable to the petitioner, the 3/5

Writ Petition is allowed and a direction is issued to the respondents to disburse the balance of the retirement benefits due to the petitioner as per rules and eligibility by considering the representation dated 28.04.2025 within a period of two months from the date of receipt of a copy of this order. No costs.
