PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying to issue a Writ of Mandamus, directing the 1st respondent to take action against the respondents 2 to 4 for illegally transferring the patta issued to the petitioner in patta No.834 in respect of the petitioner's land in S.No.664 /3A of South Avinashipalayam Village, Tiruppur South Taluk to the extent of 2.14 acres without following the provisions of Patta Passbook Act and Rules in the name of unknown persons based on the complaint made by the petitioner dated 07.06.2024 and 10.07.2024.

By consent, the above writ petition is taken up today for final disposal at the admission stage itself.

It is the contentions of the learned counsel for the petitioner that the petitioner and his brother Late Subramanian are the owners of the lands situated in S.No.664/3A in South Avinashipalayam to the extent of 2.14 acres. The said land was purchased by the petitioner's mother in the year 1940 and a patta bearing No.834 was issued jointly in the name of petitioner and his brother. When that being so, the respondents 2 to 4 issued patta to the third parties in patta No.3232 without petitioner's knowledge. Therefore, the petitioner has 2/4

made a complaint to the 1st respondent herein to take action against the officials who have colluded and issued a patta without following the Rules of the Patta Passbook Act. Since no action has been taken by the 1st respondent till now, he has filed the present writ petition.

3.Heard the learned counsel for the petitioner as well as the learned Additional Government Pleader appearing for the 1st respondent.

Though a larger relief has been sought for, this Court is of the opinion that it would be suffice to direct the 1st respondent to consider and pass orders on the representation of the petitioner dated 07.06.2024 followed by a representation dated 10.07.2024 on its own merits and in accordance with law within a period of twelve (12) weeks from the date of receipt of a copy of this order.
