Prayer:- Writ petition filed under Article 226 of the Constitution of India praying for issuance of a writ of Mandamus, directing the respondents particularly the respondents 3 to 5 to consider the petitioner's representation date 30.07.2025 sent for reinstatement of the petitioners service as Headmaster in any other school by effecting transfer. O R D E R
The writ petition has been filed for the following reliefs:- "directing the respondents particularly the respondents 3 to 5 to consider the petitioner's representation date 30.07.2025 sent for reinstatement of the petitioners service as Headmaster in any other school by effecting transfer."
2.The petitioner would submit that she had joined the services of the 2nd Respondent, as a daily wage Teacher on 03.10.1996 at the Panchayat Union Elementary School, Veppanganeri, K.V. Kuppam Union, Pasumathur Village and Post, K.V. Kuppam Taluk, Vellore District. She had served there for 14 years. On 16.10.2010, she was promoted and transferred to the Panchayat Union Elementary School, Pasumathur, where 2/5
she had served for nearly 10 years. Subsequently, she was transferred to the Panchayat Union Elementary School, Chennangkuppam, vide transfer order dated 15.11.2019, and worked there for about 7 years as Head Master. In total, she had rendered 31 years of service under the Respondents.
3. Due to personal and family circumstances following her marriage, frequent transfers, and alleged harassment by higher officials, the petitioner had faced significant distress. She had therefore submitted several representations seeking a transfer to her native District (Nellai) on 26.08.2024, 23.09.2024, and finally on 30.07.2025 to the Hon'ble Chief Minister of Tamil Nadu and the Respondents, however, no action has been taken to date. Hence, the Writ Petition.
4. Heard the learned counsel on either side.
5. Considering the facts and circumstances of the case and taking note of the fact that the respondents are duty-bound to dispose of the statutory representation, the Writ Petition is allowed. The respondents 3 to 5 are directed to dispose of the petitioner's representation dated 30.07.2025 3/5
in accordance with law within a period of 2 months from the date of receipt of a copy of this order. No costs.
