C.M.P.No.24149 of 2023 in WA.SR.No.84331 of 2023 R.MAHADEVAN, J.

AND MOHAMMED SHAFFIQ, J.

(Order of the court was made by R.Mahadevan, J.) This miscellaneous petition has been filed by the petitioners seeking to condone the delay of 1009 days in filing the above writ appeal.

2. Heard the learned Special Government Pleader appearing for the petitioners and also perused the affidavit filed in support of this petition, wherein, it has been stated that the District Educational Officer/Nodal Officer was wholly occupied in the works of conducting X, XI and XII standards public examinations 2022, exam papers evaluation, publishing results, conducting examinations for the failed candidates and conducting State Level Transfer Counselling for Teachers and Non-teaching staffs for the months of November and December, 2022, etc. Due to the same, there was a delay of 1009 days occurred in filing the appeal, which is neither wilful nor wanton and therefore, the delay may be condoned.

3. Having regard to the reasons stated by the petitioners, which appear to be bona fide, considering the huge delay in filing the writ appeal, we are inclined to condone the delay subject to payment of costs of Rs.1,000/- by the petitioners to the Tamil Nadu Mediation and Conciliation Centre, High Court, Madras, within a week's time from the date of receipt of copy of this order. 1/2 https://www.mhc.tn.gov.in/judis
