This application has been filed to accept the cause title pending disposal of the main appeal.

2. The learned counsel for the petitioner states that the 6th plaintiff and the 1st defendant were alive at the relevant time. However, they subsequently passed away, which was not brought to the notice of the trial Court. Therefore, the cause title in the judgement and decree reflects, as if the 6th plaintiff as well as the 1st defendant are alive. The petitioner has now become aware of the demise of the 6th plaintiff and the 1st defendant. Hence, the appellant being the 2nd defendant in the suit, has sought for acceptance of the cause title by including the legal heirs of the respective deceased parties to the original suit.

3. I have independently gone through the affidavit filed in support of this petition, and I am satisfied that the petitioner has made out sufficient cause and accordingly, this Civil Miscellaneous Petition is ordered. 20.02.2026 jd 1/2 https://www.mhc.tn.gov.in/judis
