No.31701/ NI4(3)/ 2017 dated 9.11.2017 and quash the same and direct the respondents to promote the petitioner as Assistant also further promote him as Superintendent by taking into consideration the regularization of his services at par with his juniors who have already been promoted as Assistant and Superintendent within a reasonable time.

The petitioner has filed this writ petition seeking quash the impugned proceedings passed by the 2nd respondent dated 9.11.2017 and direct the respondents to promote the petitioner as Assistant also further promote him as Superintendent by taking into consideration the regularization of his services at par with his juniors who have already been promoted as Assistant and Superintendent within a reasonable time.

2. The learned Senior Counsel appearing for the respondents submitted that during pendency of this case, the petitioner was granted promotion as sought for in this writ petition and the learned counsel also endorsed to the same. Hence, the present writ petition has become infructuous.

3. In view of the factual position, the writ petition is liable to be
