ORDER

The Respondent is one of the accused in a case where the respondent police registered Crime No.218 of 2025 for the offences under Section 303(2) of BNS 1 / 4

r/w 21(1) Mines and Minerals (Development and Regulation) Act, 1957, for excavating the gravel sand using four lorries.

2. The learned counsel for the petitioner submits that the gravel sand was attempted to be removed from the patta land that belongs to the first petitioner. The petitioner is the owner of one of the lorries involved and now he is before this Court seeking anticipatory bail.

3. The learned Government Advocate (Crl.Side) submits that without a valid transport permit, attempts were made to remove the sand using four lorries.

4. In view of the above facts, this Court is not inclined to grant anticipatory bail to the petitioner. Accordingly, this Criminal Original Petition is dismissed. 19-08-2025 drl 2 / 4
