PRAYER : Criminal Original Petition filed under Section 482 of Bharatiya Nagarik Suraksha Sanhita, 2023, to enlarge the petitioner on anticipatory bail in the event of his arrest in Crime No. 62 of 2025 on the file of the respondent Police.

ORDER

The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 4(1)(A) of the Tamil Nadu Prohibition (Amendment) Act, 2024 in Crime No. 62 of 2025, on the file of the respondent police, seeks anticipatory bail.

2.The case of the prosecution is that when the respondent police was on regular patrol duty, they intercepted the vehicle bearing registration No.TN 04 BB 5106 and found that the petitioner along with other accused were found to be in illegal possession of 278 bottles of foreign liquor. Hence, the case.

3. The learned counsel for the petitioner submits that the petitioner is an innocent person and he has been falsely implicated in this case. He submits that he has not committed any offence as alleged by the prosecution. He also submits that the petitioner is ready to abide by any conditions that may be imposed by this Court. Hence, he prays for grant of anticipatory bail to the petitioner.

4. The learned Government Advocate (Criminal Side) appearing for the respondent police submitted that the petitioner along with other accused were found to be in illegal possession of 278 bottles of foreign liquor. Hence,he opposed for grant of anticipatory bail to the petitioner. Page No.2/4

5. The petition for anticipatory bail in connection with seizure of 278 bottles of foreign liquor. The petitioner is the owner of the godown in which the liquor had been concealed.

6. Considering the quantity of IMFL recovered, this Court is not inclined to grant anticipatory bail to the petitioner. Accordingly, the Criminal Original Petition stands dismissed.
