O R D E R
The petition for anticipatory bail in Crime No.297 of 2025 for the alleged offence under Sections 296(b), 115(2), 329(4) & 351(2) of BNS (Sections 294(b), 323, 447 & 506(i) of IPC) r/w Section 4 of TNPWH, on the file of the respondent 1/5
police.
2. The case of the prosecution is that on 03.08.2025, in the morning, there was a quarrel between the defacto complainant and the accused person. While the defacto complainant was travelling in his car in the evening, the accused person went to the house of the defacto complainant, attacked him, caused injuries and also abused him in obscene language, threatening him with dire consequences. Hence, the complaint.
3. The learned counsel appearing for the petitioner submits that the defacto complainant and the petitioner are residing in the same village, and due to previous enmity, the complaint has been lodged. 4.
The learned Government Advocate (Crl. Side) submits that the injured / defacto complainant was discharged from the hospital after treatment.
5. Considering the nature of the complaint and the enmity prevailing 2/5
between the defacto complainant and the petitioner herein, this Court, while granting anticipatory bail to the petitioner, imposed the following conditions:

Accordingly, the petitioner is ordered to be released on bail in the event of arrest or on his appearance, on or before 28.08.2025 before the learned District Munsif cum Judicial Magistrate, Thirukazhukundram, on condition that the petitioner shall execute a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned, and on further condition that: [a] if the petitioner fails to surrender before the said Magistrate on or before 28.08.2025, this Order shall stand automatically cancelled;
[b] the sureties shall affix their photographs and Left Thumb Impression in the Application for Surety ship [Judicial Form No.46 annexed to 'The Criminal Rules of Practice, 2019']. The learned Magistrate shall obtain a copy of any one of the identity proofs to ensure their identity; [c] the petitioner shall stay at Sriperumbudur and report before the Sriperumbudur Police Station, daily at 10.30 a.m, until further orders;
[d] On breach of any of the aforementioned conditions, the learned Magistrate/Trial Court is entitled to pass 3/5
appropriate orders against the petitioner in accordance with law as if the aforementioned conditions have been imposed and the petitioner released on bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [(2005)13 SCC 283];
[e] If the accused thereafter absconds, a fresh FIR can be registered under Section 269 of B.N.S.
