The petitioner who apprehends arrest at the hands of the respondent police for the alleged offences punishable under Sections 147, 148, 294(b), 323, 324, 307 and 506(ii) of IPC, in Crime No.79 of 2022, seeks anticipatory bail.

2. The case of the prosecution is that there was a money transaction between the petitioner and the injured, due to which the petitioner called the victim to the petitioner's house to repay the amount borrowed by him. At that juncture, all accused persons attacked the injured with sticks and other weapons, due to which, he sustained cut injury on his left hand and he also lost one finger. Hence, the complaint.

3. The learned counsel for the petitioner submitted that the petitioner is an innocent person and no way connected with the alleged offence. He further submitted that this is the fourth anticipatory bail petition filed by the petitioner and the petitioner is ready and willing to abide by any stringent conditions that may be imposed on him. Hence, he prays to grant anticipatory bail to the petitioner.

4. The learned counsel for the Intervener opposed grant of anticipatory bail to the petitioner.

5. The learned Additional Public Prosecutor submits that the petitioner is a history sheeter and he is having 7 previous cases and there is no change of circumstances after the previous dismissal orders passed by this Court. Hence he vehemently opposed to grant anticipatory bail to the petitioner.

6. Taking into consideration the facts and circumstances of the case and that there is no change of circumstances, this Court is not inclined to grant anticipatory bail to the petitioner.
