By an earlier order dated 26.06.2023 passed in W.P.No.18664 of 2023, the 3rd and 4th respondents in the Writ Petition were directed to consider the petitioner's representation dated 05.04.2023, seeking for disbursement of the DCRG benefits together with interest. Thereafter, the Society had filed an application seeking for extension of time to pay the retirement benefits in 10 monthly instalments. However, through an order dated 16.11.2023, the Society had paid a sum of Rs.2,00,000/- through Cheque and offered to pay the balance amount with interest in three equal monthly instalments, to which the petitioner had agreed.
2.In this background, when the application seeking extension of time was listed on 18.12.2023, further time was sought for by the Administrator. Declining the request, the matter was adjourned. 3.Today, when the matter is listed, the learned Standing counsel for the Administrator of the Society submitted that the entire DCRG benefits together with interest has already been paid to the Writ petitioner through a cheque 1/3
No.010541 dated 20.12.2023 for a sum of Rs.9,89,883/-. 4.In view of the disbursement of the DCRG benefits to the writ petitioner, the earlier interim order passed by this Court in WMP.No.28915 of 2023 in WP.No.18664 of 2023 dated 18.12.2023 is hereby recalled. It is made clear that the official respondent shall not place reliance on any of the observations made by this Court in WMP.No.28915 of 2023 in WP.No.18664 of 2023 dated 18.12.2023. In case the petitioner was of the view that entire DCRG benefits has not been disbursed and there is a still further claim, liberty is granted to the petitioner to make a representation seeking for release of disputed amount, which shall be considered by the Society as expeditiously as possible. 5.In this background, this Writ Miscellaneous Petition is ordered. 22.12.2023 gd M.S.RAMESH,J.
