Nagar by encroaching the public park illegally in view of the fundamental right guaranteed under Article 21 of the Indian Constitution.

ORDER

(Order of the Court was made by S.M.Subramaniam J.) The Writ Petition has been instituted seeking a direction to the 1st respondent to implement their order dated 28.05.2020.

2. The said order would show that the Assistant Commissioner, West Zone, Coimbatore had informed the petitioner that actions are initiated for removal of deity illegally installed by some unknown persons. Admittedly, the deity has been put up by some unauthorized person without obtaining any proper permission from the District Collector in the manner known to law.

3. Since it is an illegal erection of deity inside the park area, the respondents are directed to remove all such installation of deity or any other statue inside the public park within a period of four (4) weeks from the date of receipt of a copy of this order.

4. With the above direction this Writ Petition stands allowed. No costs.
