ORDER
The petitioner has filed the present Writ Petition praying for issuance of a Writ of Mandamus to direct the respondents to regularise the services of the petitioners in terms of G.O.Ms.No.72, dated 05.05.1998 and in the light of the representation, dated 02.01.2025 submitted by the petitioner and in the light of similar order passed in the case of R.Rajkumar and A.J.Johnson, vide proceedings in Na.Ka.No.3551/2017/C1, dated 22.11.2018 within a time frame to be fixed by this Court.
2. The petitioner joined as NMR worker in the year 1996 under the second respondent Town Panchayat, which was later upgraded as Municipality. In 1996, G.O.Ms.No.125, was issued by the Government for regularising the services of NMR employees. In 1998, G.O.Ms.No.198 was issued for regularisation of employees on water supply, electrician, fitter, etc. In 1998, G.O.Ms.No.72 was issued regularising the service of of the employees. On 13.12.2000, the petitioner was brought on consolidated pay with retrospective effect from 01.10.2000. In the year 2006, the petitioner's services were brought in time scale of pay with effect from 2006. Since this was done in violation of the Government Orders and also several Court orders, the petitioner filed W.P.No.27309 of 2013, which was allowed, directing the respondents to bring 2 / 5
the petitioner on regular time scale of pay with effect from the date he completed 3 years of service on consolidated pay. In the year 2019, this Court passed orders in W.P.No.9131 of 2012, which was duly complied with by the respondents. However, the petitioner stated that though the posts were sanctioned and regular vacancies were also available, their services were not regularised in terms of G.O.Ms.No.125 or G.O.Ms.No.72. If that had been done, the petitioner would have got appointment before 01.04.2003, which would have made them eligible for pension and other consequential benefits. Further, on 02.01.2025, the petitioner submitted joint representation to the respondents, and since no action has been taken, the petitioner has filed the present Writ Petition for the relief stated supra.
3. Heard both sides and perused the materials available on record.
4. Taking into account the facts and circumstances of the case, the respondents are directed to pass orders on the petitioner's representation, dated 02.01.2025, on merits and in accordance with law, within a period of 12 weeks from the date of receipt of a copy of this order.
5. With the above direction, the Writ Petition is disposed of. There shall be no order as to costs.
