The petitioner stands accused in Spl.S.C.No.22 of 2021, on the file of the Special Court for Exclusive Trial of Cases Under POCSO Act, wherein, charges had been framed under Sections 363, 366, 376(2)(n) IPC and Sections 5(I), 6 of POCSO Act, 2012.
2.The learned counsel for the petitioner stated that the petitioner could not appear before the Court on 01.06.2023 and hence, Non-Bailable Warrant was issued against the petitioner. Thus, he seeks for grant of bail to the petitioner.
3.The learned Government Advocate (Crl.Side) stated that NonBailable Warrant had been issued by the Trial Court on 01.06.2023 and it was executed on 16.08.2023. It is further stated that the matter is now posted for trial and for recording evidence of the defacto complainant and her father on 19.10.2023. Thus, he prayed for dismissal of this petition. 4.Let the evidence of the crucial witnesses be completed and thereafter, let there be an examination of the nature of evidence tendered by the 1/3
defacto complainant primarily. After that, the petitioner herein is given liberty to file a fresh petition.
5. At this stage, I am not inclined to grant bail to the petitioner herein. Accordingly, this Criminal Original Petition stands dismissed. 10.10.2023 mkn2/sli 2/3
