ORDER

The petitioner, who was arrested and remanded to judicial custody on 01.07.2025, for the offences punishable under Sections 123 of BNS, Act, 2023 and Section 22(a) Cigarette and Other Tobacco Products Act, 2003 in Crime No. 390 of 2025, on the file of the respondent police, seeks bail.

2. The case of the prosecution is that the petitioner along with other accused alleged to have been illegal possession of 730 kgs of banned tobacco products. Hence, the case.

3. Learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case. He submits that the petitioner has not committed any offence as alleged by the prosecution. He further submitted that the petitioner is ready to abide by any stringent conditions that may be imposed on him. Hence, he prayed for grant of bail to the petitioner.

Learned Government Advocate (Criminal Side) appearing for the respondent police submits that there are totally two accused and the petitioner/A1 is having four previous cases which are similar in nature and he is the supplier of the banned tobacco products worth Rs.5 lakhs. Hence, he opposed for grant of bail to the petitioner.

5. Heard both sides and perused the materials available on record.

6. The petitioner, who is the supplier of banned tobacco products, was arrested on 01.07.2025 in connection with the seizure of 730 kg of banned tobacco products. The learned Government Advocate (Criminal Side) submits that this petitioner is having four previous cases which are similar in nature and he is the supplier of the banned tobacco products. The learned counsel for the petitioner submits that A2, who had the possession of contraband, already granted bail. Hence, he seeks parity. However, this Court, considering the antecedent and role of the petitioner, is not inclined to grant bail at this juncture. Accordingly, the Criminal Original Petition stands dismissed for the present.
