PRAYER:
Writ Petition filed under Article 226 of the Constitution of India for issuance of a Writ of Mandamus,directing the respondents 1 & 2 to take appropriate departmental action against the 3rd respondent for misusing his official power by considering the petitioner's representation dated 12.10.2019.

O R D E R
The limited grievance of the petitioner is that he had given a complaint against the third respondent herein with certain allegations of misuse of powers and sought for initiation of departmental action against him. This Court does not intend to go into the veracity of the said allegations since that could have a bearing on the out come of the departmental enquiry, in any. Nevertheless, if the first respondent is directed to consider the petitioner's representation, which is claimed to be given on 12.10.2019, the ends of justice could be secured.

In the light of the above observation, there shall be a direction to the first respondent to consider the petitioner's representation dated 12.10.2019 made against the third respondent herein and take further course of action. In case, the first respondent is of the view that an enquiry is required as against the third respondent, due opportunity shall be extended to the third respondent before taking any further action.
The first respondent shall also endeavour to complete the proceedings as expeditiously as possible, in any event within a period of three months from the date of receipt of a copy of this order.
In view of the above, this Writ Petition is disposed of, accordingly.
