ORDER

The petitioner has filed this petition to direct respondent to issue patta in 1/6

the name of the petitioner by sub dividing of Survey No.85/1 of Midethipalli Village of Shoolagiri Taluk, Krishnagiri on the application of the petitioner vide Can No.1333310915624154 and application No.2021/0105/31/309654 dated 30.10.2021 within the time frame fixed by this Court. 2.The case of the petitioner is that the property in S.No.70/3 and an extent of Acre 3.50 Cents out of an extent of 97 Acres comprised in Survey No.85/1 of Midethipalli Village of Shoolagiri Taluk originally belongs to one Sonnamma by virtue of a Sale Deed registered as Doc.No.3861 of 1980 dated 14.07.1980 from one Chinna Tambi Shetty. The said Sonnamma along with her family members jointly sold the properties in dispute to and in favour of on M.K.Gopal under a registered Sale Deed registered as Doc.No.1581 of 2006 dated 08.06.2006. The said M.K.

Gopal executed a registered Gift Settlement Deed to the petitioner under a registered as Doc.No.5312 of 2007 dated 07.12.2007. Based the said Gift Settlement Deed, the petitioner made an application through online for sub division patta transfer vide Can No.1333310915624154 and application No.2021/0105/31/309654 dated 30.10.2021 to the respondent. However, till date no orders has been passed. Hence, the petitioner has filed the present Writ Petition.

3.Learned counsel appearing for the petitioner would submit that this Court may issue a direction to the respondents to consider the petitioner's online application in Can No.1333310915624154 and application No.2021/0105/31/309654 dated 30.10.2021 . Accordingly, he prays for appropriate orders.

4.Mr.U.Baranidharan, learned Additional Government Pleader appearing for the respondents submits that if any direction is given by this Court, the same will be complied with.

5.Heard the arguments advanced on either side and perused the materials available on record.

6.In view of the aforesaid submissions, this Court without expressing any opinion on the merits of the case directs the respondent to consider the petitioner's online application for mutation of Revenue Records in Can No.1333310915624154 and application 3/6

No.2021/0105/31/309654 dated 30.10.2021, on merits and in accordance with law and pass appropriate orders, within a period of twelve weeks from the date of receipt of a copy of this order.
