Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus, to direct respondents 1 to 3 to approve the appointment of petitioner in the regular sanctioned post of Office Assistant in the 4th Respondent School from the date of appointment on 20.08.2018 and to make the payment of salary with all consequential and other service benefits, within a time frame to be fixed by this Hon'ble Court.

O R D E R

The prayer sought for in this Writ Petition is to direct respondents 1 to 3 to approve the appointment of petitioner in the regular sanctioned post of Office Assistant in the 4th Respondent School from the date of appointment on 20.08.2018 and to make the payment of salary with all consequential and other service benefits, within a time frame to be fixed by this Hon'ble Court.

2. The case of the petitioner is that on 20.08.2018 he was appointed as Office Assistant in the 4th respondent Aided School and immediately after appointment the proposal was sent to the 3rd respondent. On 21.02.2019, the 3rd respondent forwarded the proposal to the 2nd respondent. On 05.03.2019, the 2nd respondent returned the proposal for appointment of the petitioner for certain compliance. On 08.08.2019, after the compliance as per proceedings dated 05.03.2019, the 3rd respondent again forwarded the proposal to the 2nd respondent for appointment of the petitioner as Office Assistant in the 4th respondent School. However, till date the said proposal was not considered.

3. The learned counsel for the petitioner would submit that it would be suffice to issue direction to the 2nd respondent to consider the proposal dated 08.08.2019 in accordance with law.

4. Mr.C.Munusamy, Special Government pleader would submit that the proposal will be considered in accordance with law.

5. Considering the limited request made by the learned counsel for the petitioner, this Court hereby directs the 2nd respondent to consider and dispose of the proposal dated 08.08.2019, on merits and in accordance with law, within a period of twelve weeks from the date of receipt of a copy of this order.

6. The Writ Petition is disposed of with the above direction. No costs. Consequently, connected Miscellaneous Petition is also closed.
