The learned counsel for the respondent has filed memo dated 07.12.2022 stating that they have taken over the outlet on 19.11.2022. The said memo is taken on record. The learned counsel for the applicant also confirms the same. The learned counsel for the applicant submits that in view of the memo filed by the respondent, this application would become infructuous since the outlet was taken over as early as on 19.11.2022.

2. The learned counsel for the respondent fairly submits that the disputes between the applicant and the original landlords, who are the husband and son of the lessor of the property, are resolved and the respondent is ready and willing to hand over the petrol bunk to the applicant in terms of the dealership agreement dated 03.03.2014.

3. In view of the same, the application is dismissed as infructuous. However, it is made clear that it would not preclude the parties to invoke the clauses in the dealership agreement dated 03.03.2014 to resolve the disputes between them. No costs.
