The present petition has been filed seeking to condone the delay of 23 days in filing the petition to set aside the order of dismissal for default dated 08.08.2009 made in W.P.21953/2013.

When the matter is called, the learned Counsel for the petitioner submitted that the petitioner is aged about 81 years and he has got a fair chance to succeed in the writ petition, but, due to inadvertence, the matter could not be prosecuted by the Counsel. Hence, for the fault committed by the learned Counsel for the petitioner, the innocent petitioner should not be penalised. 3.
Accepting the submission of the learned Counsel for the petitioner, the delay is condoned.
