Prayer: Writ Petition is filed under Article 226 of the Constitution of India for issue of Writ of Mandamus, directing the respondents to pass orders for appointment of petitioners as Technical Assistant / Overseer in Cuddalore district based on restoration of Employment Exchange seniority consequent to tenure post of Technical Assistant held by the petitioners in Rural Development Department till August 2016, on par with similarly placed persons given appointment, in consideration of representation submitted by the petitioners, within a time frame to be fixed by this Court.

O R D E R
The Writ Petition is filed for the following relief: "directing the respondents to pass orders for appointment of petitioners as Technical Assistant / Overseer in Cuddalore district based on restoration of Employment Exchange seniority consequent to tenure 2/7
post of Technical Assistant held by the petitioners in Rural Development Department till August 2016, on par with similarly placed persons given appointment, in consideration of representation submitted by the petitioners, within a time frame to be fixed by this Court".

The petitioners would submit that they had qualified with Diploma in Civil Engineering and having completed one year of Apprenticeship training, were selected through the District Employment Exchange and appointed as a Technical Assistants in July 2013 in Cuddalore District for implementation of the Special Housing Scheme for Thane affected districts. Their appointments were made after due selection process including written test and following the Rule of Reservation. They were engaged on consolidated pay and their services continued until their termination in August 2016.
3. Following their termination their names were removed from the Employment Exchange records on the ground that they had been 3/7
employed through proper selection. This removal from the Live Register has resulted in their exclusion from consideration for future vacancies, despite the petitioners possessing valid qualifications and prior experience in the Rural Development Department. The petitioners are aggrieved by the denial of further employment opportunities.

The petitioners would submit that in similar matters, this Court has directed the restoration of seniority in Employment Exchange and granted relief to similarly placed persons by directing consideration for future vacancies with age relaxation. Therefore, the petitioners sent a representations seeking consideration for appointment as Technical Assistant / Overseer by relying on their past employment and seniority. However, there is no response. Therefore, the petitioners are before this Court.
5. Heard the learned counsels on the either side and perused the records.

Considering the fact that the petitioners' names have been removed from the Employment Exchange records and the fact that the petitioners' representations have not been considered to date, the respondents are directed to consider the representations made by the petitioners within a period of 2 months from the date of receipt of a copy of this order.
7. The Writ Petition is allowed with the above direction. Consequently, the connected miscellaneous petition is closed. No costs.
