The petitioner/A2, who was arrested and remanded to judicial custody on 02.04.2023 for the offences punishable under Sections 8(c) r/w 20(b)(ii)(c), 25 and 29(1) of Narcotic Drugs and Psychotropic Substances Act, 1985 in C.C.No.361 of 2023 on the file of the II Additional Special Court under NDPS Act, Chennai, seeks bail.
2.It is stated that the total quantity of Ganja seized was 37 Kgs. It is contended that it was seized from outside the car, which belonged to the mother of the petitioner herein. It is also stated that A3 and A4 had been granted bail. It is therefore contended that, since A3 and A4 had been granted bail, this petitioner should also be given the same consideration. 3.On the side of the respondent, however it is stated that the vehicle stands in the name of the mother of the petitioner herein and that all the four accused were in constructive possession of 37 Kgs of Ganja, which is commercial quantity.

Let the charges be framed, which would be the significant change in circumstance of the case. 5.At this stage, this Court is not inclined to grant bail to the petitioner.
