Purushothaman v. State Rep.By
Crl.O.P.No.23257 of 2023 C.V.KARTHIKEYAN , J.
The petitioner who was arrested and remanded to judicial custody on 14.08.2023 originally registered for the offence under Section 174(1) of Cr.P.C and subsequently, altered to Section 302 of IPC in Crime No.453 of 2023 on the file of the respondent Police, seeks bail. 2.According to the respondent, there was on going property dispute between the petitioner's family and the neighbour's family. Taking advantage of that dispute, it is alleged that the petitioner had strangulated his own father and thrown the blame on the neighbour. After much investigation and nearly after 30 days, it was found that the petitioner has caused the murder. 3.Taking into consideration the fact that the petitioner had not only committed the murder of his own father but had also thrown the blame on an innocent person, this Court is not inclined to grant bail to the petitioner. Let the Magistrate commit the case to the Court of Sessions and let charges be framed and thereafter, if there is further change of circumstances, the relief can be considered.
5.Hence, this Criminal Original Petition stands dismissed. 10.10.2023 vkr https://www.mhc.tn.gov.in/judis 1/2
