O R D E R
This criminal original petition has been filed to direct the respondents 1 and 2 Police to provide police protection to the petitioner for entering into her home, on the basis of the representation dated 20.09.2024.
2. The case of the petitioner is that the petitioner is a senior citizen and has been suffering from a pelvic bone fracture and living along with the third respondent. The third respondent is her daughter and fourth respondent is her son-in-law. The respondents 3 and 4 approached the petitioner for their financial assistance and requested a sum of Rs.4,00,000/- for home expansion and Rs.2,25,000/- for purchasing a car. Subsequently, the fourth respondent obtained the petitioner's signature on a gift deed, which was registered on 06.01.2023, without her consent. When the same was questioned by the petitioner, the respondents 3 and 4 threatened the petitioner and evicted her from their home. Therefore, she 2/5
approached the Revenue Divisional Officer, Coimbatore North Taluk and filed a petition under the Maintenance and Welfare of Parents and Senior Citizens Act, 2007. After conducting a thorough enquiry, the said Revenue Divisional Officer by order dated 27.08.2024 restored the ownership to the petitioner. Thereafter, the respondents 3 and 4 verbally abused the petitioner and not allowed to enter into their home. Therefore, she made a representation to the respondents 1 and 2 on 20.09.2024, however, no action was taken. Hence, this Petition has been filed.
3. Heard Mr.S.Vidhya Sagar, learned counsel for petitioner and Mr.L.Baskaran, learned Government Advocate appearing on behalf of respondents 1 and 2.
4. Learned Government Advocate appearing for respondents 1 and 2 submitted that a decision will be taken on the petitioner's representation dated 20.09.2024 at the earliest.
5. In view of the same, this Criminal Original Petition is disposed of directing the first respondent / Superintendent of Police to conduct 3/5
enquiry with regard to the threat given to the petitioner and also to take a decision on the petitioner's representation dated 20.09.2024 and pass appropriate orders on merits and in accordance with law as expeditiously as possible.
6. With the above direction, this Criminal Original Petition is disposed of.
